    This paper examines the employee protection arrangements for “vulnerable” workers in the event of a business restructuring under subpart 1 of Part 6A of the Employment Relations Act 2000 (ERA).  Under the legislation, vulnerable workers have the right to:(a) elect to transfer to the new employer on the same terms and conditions; (b) bargain with the new employer for redundancy entitlements if made redundant for restructure-related reasons; (c) apply to the Authority to determine redundancy entitlements where the parties cannot agree.
